Use of the Art Sales Index database
1. The database service is known as 'artauctionresults.com'. The terms and conditions of use set out below govern your use of the database (the "Site"). Your use of the Site signifies your acceptance of these terms and conditions.

2. Art Sales Index Ltd. grants you a non-exclusive, non-transferable, limited right to access the Site, provided that you comply fully with the terms and conditions of use. You shall not interfere or attempt to interfere with the operation of the Site in any way through any means or device.

3. Your right to use this product is limited to a single authorised user. Additional users may be added by prior agreement at an extra cost as shown on the current price list.

Prices and payment
4. The current price list is displayed on this web site, and you will pay for the services used in accordance with your subscription. You are fully responsible for all charges that accumulate on your account. Art Sales Index Ltd. may change prices by one month's notice to you. You may cancel this agreement immediately should such changes be unacceptable.

5. Art Sales Index Ltd. will invoice you periodically by agreement, and you will pay all invoices within 30 days of the date of invoice. If you fail to make payment on the due date, Art Sales Index Ltd. reserves the right to impose a surcharge of 4% above the base rate.

Termination
6. Either party may terminate this agreement by giving 3 months notice to the other party in writing. In the event of any of these terms being broken, termination of the service may be immediate.

Database owners' limitations
7. You agree to observe the conditions of use of the Art Sales Index database. You agree not to copy data in machine-readable form from an Art Sales Index Ltd. database without the written permission of Art Sales Index Ltd. Exceptions to these conditions that are not injurious to Art Sales Index Ltd. in the judgment of Art Sales Index Ltd. will be freely granted but they must be specifically requested in writing by you and approved in writing by Art Sales Index Ltd. You agree not to use any information and data obtained from the Art Sales Index Ltd. database for providing any other database interrogation service nor to form the basis of any printed matter for distribution or sale. Furthermore you agree not to employ any machine-assisted method for the purpose of downloading data in high volume for off-line use. You further agree that neither the maker of this agreement nor the performance of its provisions will be construed to constitute either of the parties hereto as an agent, employee, partner, joint venture or legal representative of the other.

8. Images are being added to the database with the consent of the image provider for the purpose of developing awareness and appreciation of an artist and his work. They are meant as guide only and should not be used for any other purpose than stated. If any copyright issues arise, the copyright holder should contact ASI who will then remove the image from the database.

Continuity of Service
9. Art Sales Index Ltd. reserves the right to terminate, amend, extend or withdraw features, add new features or improve or modify other service features in its sole discretion at any time without liability.

10. Repair, back-up or maintenance work on computers or transmission equipment and other causes outside Art Sales Index Ltd.'s control may cause Art Sales Index Ltd. to withdraw or change the Site temporarily and Art Sales Index Ltd. reserves the right to do this.

Limitation on liability
11. Art Sales Index Ltd. makes no warranty expressed or implied that the data supplied by the Service is suitable for any particular purpose, nor that it is correct, complete or up-to-date. Art Sales Index Ltd. shall have no liability for any default resulting from circumstances beyond its reasonable control.

12. The Site contains links and pointers to other related Internet sites which are maintained by third parties. Links do not imply that Art Sales Index Ltd. is affiliated to or associated with these third parties and Art Sales Index Ltd. accepts no responsibility of any kind for the content or maintenance of any linked site.

13. Art Sales Index Ltd. will use all reasonable efforts to ensure the performance of the Site, but shall not be responsible for any failure of for delays in performance of the Service and in the event of such delay or failure, Art Sales Index Ltd. maximum liability shall be limited to correcting any deficiencies or to canceling, crediting or refunding as appropriate charges in respect of single erroneous or inaccurate data elements of such failed performance.

Law
14. This agreement will be effective upon your using the Site. It forms the entire understanding between the parties relating to the Service. If you do not agree to be bound by these terms and conditions, you may not access or otherwise use the Site.

15. The restrictions on use of output from the Service herein continue notwithstanding the termination of this agreement.

16. This agreement shall be governed by the laws of Phoenix, AZ, USA.
