Barnes Will Move: Student Appeal Thrown Out by State Supreme Court

Published: April 28, 2005
PHILADELPHIA - When Dr. Albert C. Barnes established The Barnes Foundation in 1922, he meant for it to stay where it was. Eighty-two years later, the Foundation asked for permission to move the multi-million dollar collection from Marion, PA to Philadelphia, telling Judge Stanley Ott that if the collection were not moved, it would be left penniless. Judge Ott agreed, but Jay Raymond, an art student at the foundation, appealed the decision in January of this year.

In response to the appeal, The Barnes Foundation asked the high court to quickly review the case, stating that drawn out proceedings would hinder fundraising efforts and put their already shaky finances in peril. Yesterday, Raymond's appeal was thrown out in a four-page ruling, and the Barnes will move its collection of Matisses, Cezannes, and other masterpieces to the museum district of Philadelphia.

Measures of sadness and joy affected the opposing sides. "I am disappointed," said Raymond. "This does not comply with Dr. Barnes' wishes." But Rebecca Rimel, the president of the trust that is helping to raise the money for the move, "couldnt be happier."
