Jewelry-Deal Lawsuit Against Gehry Dismissed

LOS ANGELES—An L.A. Superior Court judge has dismissed a lawsuit against Frank Gehry that claimed a breach of contract involving proceeds from the sales of jewelry designed by the celebrated architect. The judge granted a motion by Gehry's lawyers to throw out the case on the grounds that an alleged agreement between Gehry and Circa Publishing Enterprises was not in fact in place. According to Circa’s attorney, Richard Grossman, the company entered into a written agreement in 2003 with Gehry Design in which Circa would have exclusive rights to produce, distribute, and sell jewelry designed by Gehry. Circa was entitled to half the proceeds of items sold under the deal, Grossman said.

But Circa officials later introduced Gehry to Tiffany & Co. representatives, leading to an understanding between Circa and Tiffany that Circa would distribute and sell items with the Gehry trademark, Grossman said. Gehry and Gehry Design later signed a direct contract with Tiffany that excluded Circa's services, according to Grossman. Gehry’s lawyer maintained that Circa’s contract was given back to Gehry in March 2004, ending their agreement, and the judge agreed that the original deal was abandoned.
