WALTHAM, Mass.— A Suffolk County probate judge has decided not to dismiss a lawsuit brought against Brandeis University by three of its Rose Museum’s major benefactors. Meryl Rose, Jonathan Lee, and Lois Foster had filed the suit in July, seeking to prevent Brandeis from closing the Rose and selling any artwork. The school countersued in September, asking a court to dismiss the case.

With the judge's denial of the dismissal motion, the college has agreed to not sell works donated by Rose, Lee, and Foster. Brandeis will also give the attorney general 30 days’ notice and an opportunity for review if it intends to sell any other artwork.
