Fairey’s Lawyers Say They’re Still on His Case

NEW YORK—Shepard Fairey’s lawyers released a statement yesterday saying that they are still representing him in his legal battle with the Associated Press (AP), despite at least one published report that announced they had withdrawn their counsel in the wake of the artist’s admission that he had lied about the source for his Obama “Hope” poster.

The AP published a report on Saturday, that read, “Attorneys for Fairey told the AP they have withdrawn.” It turns out that is not the case. The lawyers’ statement yesterday denied that account, though it did state, “[W]e have expressed our intention to [withdraw] at an appropriate time.”

A spokesman for Fairey urged patience in seeing what would occur with Fairey’s legal representation. Asked about a timetable for the lawyers’ withdrawal, the spokesperson responded, “There's a strong possibility that they will, but then again, that may not happen. Nothing's been decided yet.”

Fairey maintains that, despite his admission of wrongdoing, he can still win the case. He argues that his poster, which used an Associated Press photograph as source material, is exempt from having to pay copyright fees because his alterations fall within “fair use” provisions in existing intellectual property laws.
