AnnKirsten Kennis, whose fresh face from a nearly three-decade-old photo graced the cover of Vampire Weekend's 2010album "Contra," put differences aside with the band, dropping a lawsuit shefiled a year ago claiming that her image was used illegally. The two sidessettled for an undisclosed amount outside of court, allowing the preppy indierockers to continue to use the photo, reported Photo District News.
The grouporiginally paid photographer Tod Brody $5,000 to license the 1983 photo for the"Contra" cover, but Kennis claimed that she had never signed an image release, allegingthat Brody provided the band with a forged consent form.
"We know where theimage came from, but we're not being very specific about her," the band toldMTV around the album's release in early 2010. "We don't know her or anything.The picture is from 1983, but the last album cover was from 2006, and they kindof look like they both inhabit the same world. When we saw this image, we justfound it very striking. And part of it is the look on her face. It's not aboutthe color of her hair, or the fact that she's wearing a Polo shirt. What makesit interesting is her face."
"Contra"immediately shot to the top of the Billboard charts when it debuted in January2010.
Vampire Weekendfired back at Brody for the purported scam by serving him with a lawsuit thatseeks to make him responsible for any liability related to the case.
Looks like thephotographer is out of luck. His lawyers withdrew from the case because hewouldn't cooperate or pay the bills, leaving him to defend himself.
